Garden gazebos have remained popular since the 16th century. It’s no surprise — they perfectly fit into the architecture of almost any garden. Although they can be made from various materials, it’s the wooden ones that are among the most popular. What formalities should you handle when planning a gazebo? A manufacturer or buying a structure in a DIY store — which is better?
What is a garden gazebo?
There is no exact definition, hence legal interpretations in this area can be quite varied. Gazebos are usually lightweight, often latticed structures built in the garden to shield from sun or rain. Such constructions are commonly built in both large gardens and small plots. Garden gazebos serve various functions, but most often they’re a place for family gatherings and outdoor activities with friends.
Legal requirements when building a garden gazebo
Although a garden gazebo may look inconspicuous, its construction may require some formalities. Most administrative bodies do not classify gazebos as small architectural objects, hence you need to ensure compliance with legal requirements before starting construction. Of course, the exact nature of the formalities depends on the type and size of the planned structure, as well as its location. Failing to meet the formalities and building a gazebo without a notification or permit can be treated as illegal construction — if reported, it can lead to time-consuming and costly legalization. We cover this topic in our article Building without a permit – everything you need to know.
Gazebo up to 35 m2 — notification
Notification applies to the construction of an garden gazebo up to 35 m2. Such structures cannot be higher than 5 meters for a pitched roof or higher than 4 meters for a flat roof or when built in ROD (Family Allotment Gardens). Also remember that by law, for every 500 m2 of plot there can be only two such structures. The notification must be submitted to the appropriate city or county office before construction begins. In the notification, specify the scope of planned works and how they will be carried out, as well as the planned construction date. You may also attach a gazebo project to the notification. If we do not receive a negative response from the office within the legally required time (usually 21 days), it means we have what’s called silent consent and we may start building. We discuss these formalities in more detail in our article Wooden houses without building permits — check the applicable regulations!
Gazebo over 35 m2 — permit
If you plan to build a garden gazebo larger than 35 m2, you should obtain a building permit. Here the formalities are more complex. After the building permit is granted, you need to apply to the Starosty Powiatowego, but expect a longer wait for a response. Applications must be submitted before starting construction. If you do not receive a negative response within the legally required time, it means you have what’s called silent consent and you can proceed with installation and construction work — you have 3 years.
Gazebo on a ROD plot — exception
Gazebos built within Family Allotment Gardens do not require a permit or notification, provided their area does not exceed 25 m2 for gardens within the city and 35 m2 for gardens outside the city. It is also important to ensure the height of the structure, which should not exceed 5 meters for a pitched roof and 4 meters for a flat roof. The gazebo floor area does not include the terrace or porch, whose combined area can account for an additional 12 m2. The intention to build a gazebo on ROD land must be reported solely to the Garden Board.
Lightweight gazebo
In accordance with current regulations, even small garden gazebos with a lightweight structure can be built without notification and permit. This applies to constructions without enclosed walls and foundations. When planning to build this type, it’s worth taking your project to the office to ask for details to ensure the build won’t be treated as unauthorized construction.
Required distances of the gazebo from plot boundaries
Size and height aren’t the only parameters to consider to ensure your garden gazebo build is legal. You should also maintain a proper distance from the property line:
- 1.5 m if there is a building on the neighboring plot at a similar distance from the boundary,
- 3 m if the wall adjacent to the boundary is built and has no entrance,
- 4 m if the wall on the boundary side has windows or an entrance.
The above requirements do not apply to lightweight gazebos (i.e., without walls and foundations).
Installation by the manufacturer or DIY assembly?
If you have experience and know wooden constructions well, there’s nothing stopping you from building the gazebo yourself. A simple garden gazebo can theoretically be made without extensive experience, but remember that even the simplest structure requires at least a provisional plan that includes area, shape, location, and required materials. Not everyone can prepare such a plan alone, which is why it’s a good idea to seek help from a company that specializes in wooden constructions. It’s not worth buying a ready-made gazebo at a hardware store, because the quality of wood and overall workmanship may come as a surprise. By choosing a ready-made gazebo from a manufacturer, you can be confident in the final visual effect, its stability, and you’ll save a lot of time on installation and potential adjustments. For gazebos with larger dimensions or more complex shapes, it’s definitely better to ask the manufacturer for help, who will also handle installation on your plot.
Where to order a garden gazebo?
Choosing a garden gazebo contractor should not be left to chance — the purchase should be carefully considered. Don’t rely on untested companies or order a structure from a local carpenter whose specialty is completely different wooden products. Lack of project visuals and example realizations, delaying deadlines, and “we’ll work it out” pricing should be strong signals to walk away from buying a gazebo from an unreliable source. A reputable manufacturer will always provide a clear quote and will be ready to answer all your questions about the construction. By choosing Drewnolandia, you can expect high-quality project design, the possibility to tailor it to your needs, excellent wood quality, and professional installation of the finished structure within the specified timeframe.
