Not on every plot can you place a holiday cabin. What determines where a recreational cabin can be built is its status, defined by the Local Spatial Development Plan.

A holiday cabin up to 70 m2, just like a single-family dwelling, can be erected without a permit, but only by notification.

Where can you build a holiday cabin?

Before starting to build a holiday cabin, check whether the plot is covered by the Local Spatial Development Plan. If the plot has a local plan, the provisions contain information on land use and the requirements for the planned development. No method of carrying out construction works may contradict the rules of the Local Spatial Development Plan. If the plan does not cover the plot, a decision on land development and development conditions must be issued before placing the holiday cabin.

Can you place a 35m2 holiday cabin on any plot without de-zoning?

On an agricultural plot it is possible to place a holiday cabin up to 35m2 if the Local Spatial Development Plan allows farmstead development, including farm buildings, livestock facilities and residential buildings. However, the regulations do not define farmstead development precisely, and only indicate that the building should be related to farmers’ work.

There is therefore no unequivocal answer whether a holiday cabin on an agricultural plot can be built by a person who is not a farmer. To be sure that all legal requirements are met, the best solution is to apply for changing the designation of the agricultural plot to a building or recreational plot.

What is the minimum building plot area for constructing a holiday cabin?

The Building Code does not specify the minimum plot area for building a holiday cabin. The only minimum building plot area may be set by the Local Spatial Development Plan.

It should also be noted that placing a recreational cabin by notification can be carried out only if the number of buildings on the plot does not exceed one cabin per 500m2 of plot area.

Can you place a 35m2 holiday cabin on any plot without a building permit?

According to the Building Code, a building permit is not required if a holiday cabin is a stand-alone, single-storey recreational building with a building area up to 35m2, but above 35m2 and up to 70m2. The cabin must also be intended exclusively for periodic leisure, with the span of structural elements not exceeding 6 meters, and a cantilever of up to 2 meters.

The 70m2 area refers to the building footprint of the plot, not the total floor area of the resulting building. Therefore a holiday cabin with a mezzanine and a terrace totaling up to 90m2 also does not require a building permit.
