Planning to build a house, but your plot isn’t covered by a local spatial development plan? In that case, one of the first steps will be to obtain a decision on the conditions of building, in short the WZ. It’s a document that specifies what and how you can build on a given site. Below we explain when such a decision is needed, how to obtain it, how much it costs, and what changes in regulations will take effect from 2026.

Legal basis for the decision on the conditions of building

The decision on the conditions of building is based on the Act of March 27, 2003 on planning and spatial development. This act specifies in which cases you must apply for it and what conditions must be met.

The WZ is issued by the executive body of the commune – i.e., the commune head (wójt), mayor (burmistrz), or city president – competent for the location of your plot. The document does not grant you ownership of the land, but indicates how the plot can be used and what building parameters are permissible.

This is important, because without the WZ you won’t be able to submit a building permit application if the plot is not covered by a local development plan (MPZP). This also applies to the notice of construction - for which WZ is also required if the plots are not covered by the MPZP. In practice, a decision on the conditions of building is essential not only for constructing all-year cabins, but also for investments such as holiday cabins.

When is the decision on the conditions of building required, and when is it not?

To put it simply: if your plot lies in an area where no MPZP has been adopted, you must obtain a decision on the conditions of building in order to start construction. You do not need the WZ only when:

  • the commune has adopted an MPZP and the plot is included in it – then the building conditions are defined by the plan,

  • the change of land use is temporary, e.g. for no longer than a year,

  • you are changing the use of an existing structure without carrying out new construction work.

Conditions for obtaining a decision on the building conditions

To issue a positive decision, you must meet several statutory requirements. A key role is played by the so-called principle of good neighborhood. This means that in the immediate surroundings of your plot there should already be other buildings whose parameters – such as height, building line, or roof shape – will serve the authority as a reference point when determining the conditions for the new investment. If there is no development nearby, the authority may refuse to issue the decision because it will have no basis for an urbanistic analysis.

Another important criterion is access to a road – it doesn’t have to be a direct entrance, a road connecting the plot to a public road is enough. Another issue is the possibility of connecting to utilities, such as water, electricity or sewage (sometimes connection conditions from network operators are required). The authority will also check compliance of the investment with special regulations, e.g., environmental protection, monuments, or flood zones, to ensure the planned house does not violate any restrictions.

How to obtain the decision on the building conditions step by step?

Obtaining the decision on the building conditions requires going through several stages. Before you submit the building conditions application, review offers from architectural offices and manufacturers of ready-made structures (e.g., holiday cabin manufacturer), to specify your expectations and enter correct information in the application (e.g., permissible building footprint, building height, roof pitch, or number of storeys). The whole procedure proceeds as follows:

  1. Submission of the application – you submit it at the commune or city hall, attaching a map of the plot with the planned investment. The authority may also request additional documents, e.g., a concept for land development or conditions for connecting to utilities.

  2. Stamp duty – the decision is free of charge for the plot owner. Other persons pay PLN 598.

  3. Administrative proceeding – the office collects opinions and agreements; in the case of plots near national roads, railways or in protected zones, additional decisions may be required.

  4. Urbanistic analysis – a clerk checks the development of neighboring plots, roof parameters, height and building lines, to determine the conditions for your investment.

  5. Issuance of the decision – the document includes, among other things, the height and dimensions of the building, the permissible building area, roof form, and how the plot will be serviced.

  6. Legitimization of the decision – notification of the document to the parties in the case. If within 14 days no one appeals, the decision becomes final and you can prepare an application for a building permit.

How long does issuing a decision on the building conditions take and how much does it cost?

The act provides that the decision should be issued within 21 days. In practice, it often takes much longer – usually 2 to 3 months. In more complex cases, e.g., when additional arrangements are necessary, the procedure can drag on up to 6 months.

The decision itself is, in most cases, free of charge. However, some attachments you must include with the application may incur costs. Their price is usually several hundred zlotys.

How long is the building conditions decision valid?

Currently (in 2025) building conditions decisions are of unlimited validity. If you obtain the WZ today, you can start construction even after several years. That offers great flexibility in planning your investment.

From January 1, 2026, changes will take effect – decisions will be issued for a limited time, a maximum of 5 years. If you do not obtain a building permit within this time, the decision will expire and you will need to submit a new application.

What to do if the office refuses to issue a decision on the building conditions?

The most common reasons for refusal are: lack of adjacent development, lack of access to a public road, or lack of ability to provide utilities. If you encounter such a situation, you have the right to appeal to the Local Government Appeal Board (SKO).

It is also worth consulting with an architect or lawyer who will help you prepare a better-documented application. Often it is enough to provide additional agreements or choose a slightly different way of carrying out the investment.

Changes in the regulations on building conditions – what will change in 2026?

New regulations on building conditions from 2026 concern a few basic issues:

  • WZ decisions will be valid for only 5 years,

  • WZ can be obtained only for plots located in areas of housing infill (OUZ), which the commune will indicate in the master plan,

  • Communes have until June 30, 2026 to prepare new master plans – if they do not do this, issuing WZ decisions will be heavily limited (however, until 30.06.2026 you can obtain WZ under the current rules if the commune has not prepared a new master plan).

For you, this means one thing – if you are planning construction, it is better to file for the WZ in 2025. A decision obtained then will be of unlimited validity, a major convenience.

Most common questions about the building conditions decision (FAQ)

Below we dispel the most common doubts and explain when and how to obtain the WZ so that the construction process runs smoothly.

When is the building conditions decision needed?

The decision is required whenever the plot is not covered by the MPZP and you plan to build a house or another building. Without this document, the authority will not issue a building permit (nor approve the notice).

Where to submit the building conditions application?

The application is submitted at the commune or city hall, proper for the location of the plot. In many communes online forms are already available, but in practice it is often required to submit documentation in paper form.

How long does it take to obtain the building conditions decision?

Typically the office needs 2-3 months to process and issue the decision. In complicated cases, when additional arrangements are required, the procedure may take longer.

How much does the building conditions decision cost?

The decision is issued free of charge if the property owner applies for the building conditions. Costs may arise, however, in connection with the need to purchase maps, additional documents, or a stamp duty if the investor is not the plot owner.

How long does the building conditions decision stay in force?

Until the end of 2025, decisions retain a non-expiring character, whereas from 2026 each new decision will be valid for a maximum of 5 years.
