Building your own home evokes years of paperwork, a mountain of documentation and bureaucratic uncertainty. Yet Polish construction law offers an alternative that considerably shortens the path to your own four walls. A permit-free home for construction is a viable, accessible solution that is increasingly popular, allowing you to implement an investment under a simplified notification procedure. At Drewnolandia we prove every day that this process can be transparent and quick.

What kind of permit-free home can you build? Key principles

Current regulations allow two types of buildings to be constructed under a simplified procedure. The first group are permit-free houses with a floor area up to 35 m². These are usually single-story freestanding buildings with a recreational or utility character. A crucial limit here is the number of such structures per plot – for every 500 m² of land, only one such building may be on the plot.

The second, newer category is permit-free house with a floor area up to 70 m². In this case we are talking about single-family residential buildings intended to satisfy personal housing needs. A key condition is that the building’s impact area must entirely fit on the plot where it was designed. This means the house cannot encroach on neighbors’ interests or limit the development of adjacent parcels.

Holiday cabins and formalities

And how does the legalization process for a holiday cabin look? It turns out that choosing a light construction and skipping foundations does not free you from informing the authorities. If you plan to place a building on a recreational plot, check our guide “Notification or building permit – what do you need for a holiday cabin?” to avoid mistakes during the formalities.

What does the notification procedure for building a house look like?

Instead of applying for a classic administrative decision, the investor makes a so-called notification of construction. The documentation is submitted to the district governor’s office or the city hall. It is also necessary to attach a declaration of construction for own needs. If the office does not raise an objection within 21 days (the so-called silent consent), construction can legally begin.

However, it is important to note that despite the absence of a "permit," the building must have a construction project (prepared by a licensed architect) compliant with local law, i.e. the Local Spatial Development Plan (MPZP) or – if it does not exist – a decision on Building Conditions (WZ). Details on risk can be found in the article “Building irregularities – everything you need to know.”

Wooden house – the ideal choice under the notification regime

When choosing the so-called permit-free home, investors most often opt for timber frame technology. Why? Because the speed of assembly perfectly aligns with the simplified legal path. The Drewnolandia structures are factory-made, and their on-site installation takes from a few days to a few weeks.

Here comes another question: how much does a permit-free home cost turnkey? The price depends on the finishing standard, insulation thickness, and type of foundation. Holiday cabins up to 35 m² represent an outlay of several tens of thousands of zlotys in a raw state, whereas all-year homes 70 m² in developer standard require higher outlays, but still remain a much cheaper alternative to buying an apartment in the city.

FAQ – Most common questions about permit-free homes

Below we collected answers to the most frequent questions regarding building under a simplified regime. We dispel doubts about formalities, floor space and legal aspects.

How many meters can a permit-free home have?

Currently, without a permit, and only by notification, you can build recreational houses up to 35 m² of built-up area and single-family homes up to 70 m² of built-up area. For the latter, the building may have an usable attic, provided its total area fits within the technical guidelines.

Where to notify for building a permit-free home?

Notifications are made at the district governor’s office or city hall appropriate for the plot location (department of architecture and construction). This can be done in person or electronically.

Can a permit-free house be sold?

Yes. A building erected under notification is a fully legitimate construction object. Notably, for houses up to 70 m² built on the basis of a declaration of residential purposes, sale is possible, but the declaration must be truthful at the time of construction.

How long does the notification procedure take?

In the standard notification mode, the office has 21 days to raise an objection. If it does not, we have the so-called silent consent.

Does a Drewnolandia recreational cabin up to 35 m² require a permit?

No, if it meets the requirements of being on one floor and the limit of one unit per 500 m² plot. Such structures are built on the basis of a simple notification. The same situation applies to smaller constructions.
